SSHNUG PRINT TEMPLATE TERMS & CONDITIONS

1. LICENSE
   Agreeing to these terms and conditions and purchasing our product grants you a nonexclusive limited license to use the sshnug print templates sold through our web site in accordance with these Terms and Conditions issued by our company (sshnug pty ltd).

1. LIMITED USAGE
   You may only use each individual product for a single print run/distribution, belonging to either you or your client. If you wish to make another project with the same design, that design must be purchased again.

2. UNAUTHORIZED USE
   You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from sshnug pty ltd.

3. ASSIGNABILITY
   You may not sub-license, assign, or transfer this license to anyone else without prior written consent from sshnug pty ltd.

4. OWNERSHIP
   You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall sshnug be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

2. PRODUCT INFORMATION

1. Unless stated otherwise, each print template includes a .pdf file and the program file it was created with. It will have clearly labelled layers, and graphics as shown in the template.

2. The appearance of the template will be identical to that shown and chosen by the client with the exception of the clients details (as described in 3, 'Client Responsibility' and 4b, 'Modifications by sshnug pty ltd'.) Any further changes will be charged at AUD$50* per hour, or the international equivalent. For an additional fee (that is dependant on the size of the print run), sshnug can organise printing and shipping to your destination.

3. If designs are altered by the purchaser, they will receive the program file it was created with (.ai or .psd), which will contain clearly labelled layers, and the design as shown in the template.

3. CLIENT RESPONSIBILITY
   This section relates to clients who wish sshnug pty ltd to modify the sshnug template details. It is not applicable for clients who intend to modify the template themselves (see 4a, 'Modifications by the User').

1. Please note that All content provided MUST be copyright of the client. No responsibility will be taken for any breach of copyright.

2. All content will be displayed without editing or alterations with the exception of graphics and photographs which may be digitally adjusted for optimal printing.

3. Before work on the print template can begin, the client must supply sshnug pty ltd with the information necessary to complete it. This includes, but is not limited to:

1. Company logo, and any photos or graphics required. Graphics or photographs must be print quality: 300dpi.

2. Custom Colour(s) if required.

3. Content text, which may not exceed 400 words.

4. On or before completion of the sshnug template, the client shall organise their own printing, provide their printer details, or (for additional costs) request that sshnug pty ltd use their own printer. Once the input of the client's content has been completed, the finished template will either be forwarded to the client (via email, CD or other agreed method), or forwarded to the applicable printer. If it is sent to sshnug's printer, sshnug will arrange delivery of the printed products to the client at the client's cost. If the completed template is forwarded to the client, it is then the client's responsibility to organise their own printing when appropriate.

5. If the client would like exclusive rights to the template design, they must pay an additional exclusivity fee of AUD$300* and the template design will be removed from the sshnug template gallery and will not be sold again.

4. MODIFICATIONS

1. MODIFICATIONS BY THE USER
   If the user decides to make their own content modifications, sshnug pty ltd assumes that the user has the necessary skills and equipment to do so, and is willing to offer a 40% discount* to the price of the chosen template. You are authorized to make any necessary modification(s) to our products to fit your purposes, with the exception of the following:

1. The user must not insinuate in any way that the design was created by anyone other than sshnug pty ltd (unless the user pays an exclusivity fee). By violating this rule without the written permission from Sshnug Pty Ltd, you fully understand you are committing Copyright infringement, and are in breach of contract.

2. MODIFICATIONS BY SSHNUG PTY LTD
   Sshnug Pty Ltd can make the following modifications on your behalf:

   1. Change text placeholder content to the users content.

   2. Insert your pictures, logos & graphics where depicted in the chosen template as "your company name", "your logo or graphic", or other similar wording.

   3. Graphics and photographs will be digitally adjusted for optimal viewing in print.

   4. Change colours (not exceeding 2) to the client's colour scheme.

   These changes are included in the price of the template.
   Changes that deviate from these will incur an additional fee.

5. ADDITIONAL DESIGN REQUIREMENTS
   For an additional fee of AUD$50* per hour, we can provide the following services:

   1. Further customisation of the sshnug template design aside from that already mentioned above.

   2. Text editing.

   3. Photography, cropping and digital enhancing of photographs.

   4. Logo and Identity design.

   5. Illustration.

   6. Brochures, Flyers, Posters, Catalogues, Business cards, stationary, web sites, web banners or buttons.

6. PRICING & PAYMENT

1. Each sshnug print template is priced as shown on the chosen template.

2. Payment for a 'sshnug' print template is for the design 'as is' with minor modifications as described in 4b, 'MODIFICATIONS BY SSHNUG PTY LTD'.

3. Further modifications as described in 5, 'ADDITIONAL DESIGN REQUIREMENTS' will incur a fee of *AUD$50 per hour.

4. A 40% discount on the price of the template will apply to users who wish to alter the designs themselves. We assume such a user has the necessary experience & knowledge.

5. Couriers, outsourced artwork/photos/publications, printing costs, delivery or shipping, and other out of pocket expenses are not included in the price, and will be charged at an hourly rate.

6. All invoices are for 7 days only. A 50% deposit will be required before work can begin. Any cancellation by the client will result in forfeit of the deposit.

7. All Australian purchases will incur 10% GST in addition to the price mentioned.

7. OUR REFUND POLICY
   Since our company is offering non-tangible irrevocable goods we do not issue refunds after the product is shipped. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is one week after the delivery date.
